1. PROMOTION SPONSOR

Companies in the INVERSIONES PLOMER SL group (through its trademark ZAFIRO HOTELS) with offices in C/Mar i Estany, 35, 07400 Puerto de Alcudia, Balearic Islands, Spain and tax ID number B-07985823 is the organiser of this online contest (hereinafter, "the Promotion") in accordance with the conditions described in the section on participation requirements.

2. PARTICIPATION REQUIREMENTS AND PROMOTION PROCEDURES

Participation requirements are as follows:

• Residents of any country aged 18 and over may participate.
• Participants must have an account in the following social media: Instagram, Facebook.
• Participants must make a comment on the original post about the prize draw either on Instagram or Facebook to take part in the prize draw by following the instructions.
• Participants may mention other friends in their comment on the post, but only the person who makes the comment will be considered a Participant.
• If participants are found to have used several different profiles, they will be disqualified. To this effect, a duplicate profile is considered to be a profile with an email address or personal data that ZAFIRO HOTELS deems sufficiently similar to create confusion.
• The Instagram or Facebook profile must be real, i.e. it must not be based on a false identity according to the criteria and valuation of ZAFIRO HOTELS.
• Under no circumstances will any vulgar or obscene words, explicit or implied denigration or disrespect for third parties nor improper content be accepted and which ZAFIRO HOTELS deems inappropriate for the correct completion of the prize draw. 

3. PROMOTION CONDITIONS

All users whose participation complies with the conditions defined herein will become participants in the prize draw.

Winners will be notified through a mention and a private message. If a prize is rejected or the winner does not meet the Promotion requirements, ZAFIRO HOTELS will announce and inform a substitute winner. ZAFIRO HOTELS reserves the right to refuse participation to any user names used that are considered improper, owned by third parties, contain trademarks or protected elements, use false identities or in general contravene the spirit of the prize draw. In such cases, users will lose any right to take part in the prize draw. Employees of ZAFIRO HOTELS and its direct or indirect partners will also be ineligible for participation.

4. PRIZES

The prize consists of a three-night stay for two people with all-inclusive service at any of the hotels operated by ZAFIRO HOTELS. The stay may be made at any time in 2019 depending on room availability at the selected hotel. If rooms are not available on the chosen date, alternative dates will be proposed. Prizes cannot be exchanged for cash or any alternative prize, nor may they be changed or altered.

The prize draw and prizes are subject to all applicable tax regulations.

5. DELIVERY OF PRIZES

The winner will be chosen in a completely random and transparent way using the Easypromos tool for prize draws and contests. If there are not enough valid participants eligible for the prize, or for any other internal reason, ZAFIRO HOTELS reserves the right to cancel the prize draw.

Winners will mentioned in a post and notified by private message from ZAFIRO HOTELS administrator profiles. Winners must accept their prize and provide their personal data for delivery of the prize by sending an email to the address provided in the private message or by replying directly to the email.

If winners do not confirm receipt of the message and acceptance of the prize within 24 hours after the message is sent, the prize will be awarded to the substitute winner. If the substitute winners do not confirm receipt of the message and acceptance of the prize, the contest will be declared void.

By accepting the prize, winners accept that ZAFIRO HOTELS may use their name, photo or portrait for advertising and promotions through any media without need for any prior or posterior notice. ZAFIRO HOTELS may eliminate any participants who do not comply with the requirements mentioned above or who attempt to participate in violation of these conditions.

6. DISQUALIFICATION AND PENALTIES

If participants do not meet the requirements in the legal conditions or if the data they provide on participation is not valid, said participation will be declared void and they will be automatically excluded from the Promotion, losing all rights with regard to any prizes awarded under the Promotion.

7. DATA PROTECTION

With reference to the General Data Protection Regulation (Regulation (EU) 2015/679) and Law 3/2018 of December 5 on Personal Data Protection and digital rights, we inform you below about the use of your personal information and other issues that may be of interest to you.

The data controller and processor with regard to your data is Inversiones Plomer SL (B-07985823), located at C/Mar i Estany, 35, 07400, Puerto de Alcudia, Spain. If you would like to contact us by email, please write to privacy@zafirohotels.com. The purpose of collecting and processing your data is to allow the prize draw to be carried out.

The processing of your data is legitimised by your participation in the prize draw and based on your consent to these conditions. The processing of your data is essential for carrying out the prize draw.

Your data may be transferred, where appropriate, to the public authorities and prize draw organisers to allow the notification and delivery of the prizes mentioned above.

Your personal data will be stored for 5 years, the period required for the limitation of any civil, criminal or administrative liabilities for Inversiones Plomer SL that may result from any irregularities during your stay or possible responsibilities arising from data processing. On completion of this period, your data will be erased.

In addition to the right to withdraw your consent for data processing at any time, you also have the following rights:

• You may request access to all your personal data that we process (right to access)
• You have a right to rectify your data (right to rectification).
• You may request the deletion of your data when the requested service has been completed (right to cancellation).
• You have the right to request that your personal data is not processed (right to opposition).
• You may also request limitations on the processing of your data (right to limitation of processing).
• You have the right to have your personal data delivered to you in electronic format so that you may view it (right to portability).

Acceptance of the prize does not impose or imply any obligatory acquisition of any kind of additional products or services. Participants accept that ZAFIRO HOTELS may use their name for advertising and promotional purposes.

The successful completion of this prize draw requires that participants commit to providing true and accurate data. If the personal data is false, incomplete or inaccurate, making the identification of participants and potential winners impossible by reasonable means, ZAFIRO HOTELS reserves the right to declare the prize draw void and remain free of any responsibility in this regard.

8. LIABILITY DISCLAIMER

Among other things, ZAFIRO HOTELS is not responsible for any possible loss, theft, delay or any other circumstances attributable to third parties that may affect the Promotion nor for the use made by participants of any prizes.

ZAFIRO HOTELS does not assume responsibility for any force majeure or fortuitous events that may impede the completion of the promotion or the total or partial enjoyment of any prizes.

9. APPLICABLE LEGISLATION AND JURISDICTION

These legal conditions will be governed in accordance with Spanish law. The Courts and Tribunals of the city of Palma de Mallorca shall be competent to resolve any claims that may arise in relation to the validity, interpretation or fulfilment of these legal conditions.
